Jan du Toit

For some reason employers and employees are still extremely confused when it comes to resignations and the subsequent issues that may arise. Let us first look at notice periods as described in the Basic Conditions of Employment Act – section 37.

  1. b) two weeks, if the employee has been employed for more than six months but not more than one year;
  1. c) four weeks, if the employee–
  1. i)  has been employed for one year or more; or
  1. ii) is a farm worker or domestic worker who has been employed for more than six months.

From the above it is clear that the Act does not make provision for a resignation with a notice period shorter than one week. In other words an employment contract may not allow for notice periods […]

  • Werknemers wat in enige van die Staats Departemente werksaam is. Die rede hiervoor is dat hierdie werkers reeds aan ʼn pensioenfonds (GEPF) behoort wat deur die Staat gesubsidieer word;
  • Werknemers wat minder as 24 ure per maand werk;
  • Immigrante wat op kontrak basis werk;
  • Werknemers wat reeds ʼn Staats (ouderdoms) pensioen ontvang

Interview Tips for your First Job Interview

The thoughts of a job interview are enough to turn veteran job hunters to jelly. For a teen or someone similar in age, the thought of interviewing for a job is more frightening than having to tell Dad you lost the car keys—again.

SA gets a reprieve after S&P delivers its verdict

South Africa’s economic fate now lies in its own hands after Standard & Poor’s (S&P) left the country’s investment largely unchanged last week.
Together with Moody’s and Fitch, these decisions must therefore be seen as friendly warnings, rather than as reprieves, about what South Africa is seen to be doing and implementing over the next few months. Although the S&P assessment also recognises the changes and improvements made so far in certain areas of policy, the reality is that the economy remains on the cusp of junk status. South Africa is still at only one notch above junk in both S&P and […]

1. Not charging a royalty on sales but rather adding margin to product

In addition, according to the Competition Act, the franchisee cannot be forced to purchase goods from the franchisor, especially if similar products are available at a lower price. If franchisees have to […]
